**Important Updates on Florida Legislation: Changes Effective December 31, 2024**

As of December 31, 2024, significant changes have been introduced to Florida legislation impacting associations and their reserve contributions. The ability for associations to waive their reserve contributions is no longer permissible. A crucial requirement now mandates that all associations must complete a Structural Integrity Reserve Study (SIRS) by the same date.

Moreover, any budget adopted on or after January 1, 2025, must utilize the findings of the SIRS to fund structural reserves. This specifically applies to the budget approved in 2025 for the fiscal year 2026. Notably, Senate Bill 4-D also holds condo board members personally liable for any failure to conduct inspections or meet reserve requirements.

To comply with the new law, associations must schedule mandatory inspections, with the deadline for most associations set at December 31, 2025. Waiting until the last minute may jeopardize obtaining renewal or optimal coverage from insurers, potentially resulting in significant fee increases and assessments to meet higher insurance premium costs.
